1. Acceptance of Terms

By accessing or using the Obfuscura platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and customers of the Service.

2. Description of Service

Obfuscura provides a PHP code obfuscation, encoding, and license management platform. The Service includes a web-based dashboard, REST API, runtime loader files, and related documentation. The Service is provided on a subscription basis with various plan tiers.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Subscription and Payment

Paid plans are billed monthly or annually in advance via Stripe. All fees are non-refundable except as required by applicable law or as explicitly stated in these Terms. You may cancel your subscription at any time; access continues until the end of the current billing period. We reserve the right to change pricing with 30 days' notice.

5. Free Trial

New accounts receive a 14-day free trial with full feature access. At the end of the trial period, your account will be paused until you select a paid plan. Encoded files distributed during the trial will continue to function as long as a valid license exists.

6. Acceptable Use

You agree not to use the Service to:

  • Encode or distribute malicious code, malware, or any software designed to harm systems or users
  • Violate any applicable laws, regulations, or third-party rights
  • Reverse engineer, decompile, or disassemble the Obfuscura runtime loader or encoding engine
  • Attempt to circumvent usage limits, licensing restrictions, or security measures
  • Resell, sublicense, or redistribute access to the Service without authorization

7. Intellectual Property

You retain all ownership rights to the PHP source code you upload to Obfuscura for encoding. Obfuscura does not claim any ownership over your code. We do not store your original source code after encoding is complete. The Obfuscura platform, runtime loader, encoding engine, dashboard, and documentation are the intellectual property of Obfuscura and are protected by copyright and other laws.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Service Availability

We strive to maintain 99.9% uptime for the license validation API. However, we do not guarantee uninterrupted or error-free operation. Scheduled maintenance will be communicated in advance. The offline grace period feature in the runtime loader ensures your customers are not affected by brief service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, Obfuscura shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Service. Our total liability shall not exceed the amount paid by you to Obfuscura in the twelve months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. While we employ multiple layers of protection, no obfuscation technique is guaranteed to be 100% unbreakable against all possible attacks.

12. Termination

We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Encoded files already distributed to your customers will continue to function for the duration of their license validity, but you will not be able to encode new files or issue new licenses.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the dashboard. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable rules.
